Professional responsibility of lawyers of International Legal Corporation "DIGESTA" is insured (the Insurance certificate № 0610 PL 0016). The sum of the current insurance premium is 5 000 000 (five million) roubles, but it can be increased with regard to specific project.
The object of the given kind of insurance are the property interests of the company connected with its duty according to the current legislation to compensate harm, caused to the client as a result of inadvertent errors associated with legal activity.
In this case the beneficiaries are the clients who concluded the contract on rendering of services with the Insurer.
The risk of responsibility of the company is insured associated with legal activity of the lawyers who concluded the labour contract with the company.
The insurance cases are:
insurance case on a trespass against the client as a result of inadvertent errors of the company associated with legal activity, i.e.:
unreasonable application of norms of the right for settlement of legal relations with participation of the client (closure of deals, consultations on law branches, representation of interests of clients, and etc.);
delays of cassations (complaints);
wrong preparation of documents (inquiries, and etc.) – preparation of documents with infringement of requirements on the form, content, and etc.;
not notification of the client about consequences of made legal actions that has entailed causing him harm because of legal lack of information;
loss or damage of the documents received by the company from the client for legal activity;
illegal disclosure of information, disclosure of the documents, which became known to the company, its workers in the course of legal activity.
Note should be taken that up till now we did not resort to reception of insurance payments.
